In answer to your questions:

1. when kick starting seems to be slipping have to kick it a few times for it to start

The clutch is slipping, most likely cause is the use of car oil at some time in it's life. You can try swapping to mineral bike oil but usually you need to replace the clutch plates.


2. when finally started keeps cutting out even when warm

Your later note about the float bowl overflow is key here, it sounds like your float needle valve is not sealing and flooding the carb. This will make the mixture rich enough to run erratically - basically it needs the carb sorting.

3. when riding seems to stick in 2nd gear have to really stamp on it to change it

This should not be the case, pressing the gear lever should declutch - do a quick test; start the bike and pressdown the lever and rev it up with the lever still depressed. If the bike pulls forwards then the clutch actuating mech has been assembled incorrectly. A rather common fault.

4. pulls well in 2nd when in 3rd and when on slight incline it bags out wont go over 30 (i'm 16 stones:))
